Terms and Conditions

The following Terms and Conditions set forth the full, written intention of both parties and supersedes all other written and/or oral agreements between the parties.

1. SERVICE PERIOD.
Our firm will provide continuous service and communication, with the understanding that occasional administrative delays may occur due to documentation processing or third-party scheduling (e.g., property showings, inspections, or lender coordination).

2. PAYMENT TERMS

If a retainer or partial deposit is accepted, the balance will be due before any offer submission or document execution. Failure to complete payment within the specified timeline may result in the suspension or cancellation of service without refund of previous deposits.

3. ACCESS TO PROPERTY

Access requirements such as lockbox codes, scheduled appointments, or onsite agent presence will be communicated in advance.

4. INSURANCE REQUIREMENTS

Buyers engaging in investment or construction transactions acknowledge that the Agency may require proof of property insurance, builder’s risk coverage, or liability protection. Where applicable, the Agency will maintain its own professional liability and E&O coverage throughout the representation period.

5. COMMUNICATION TERMS – SMS / EMAIL CONSENT

By providing contact details to [Agency Name], the Buyer consents to receive transactional and marketing communications via text message or email. These messages may include appointment reminders, status updates, or promotional content. Standard data rates may apply. To opt out of SMS communications, reply STOP. To opt out of email communications, use the unsubscribe link or contact us directly.

6. GENERAL & MISCELLANEOUS

If any clause within this agreement is deemed unlawful or unenforceable, it shall not affect the validity of the remaining terms. All modifications to this agreement must be made in writing and signed by both parties. In the event of a dispute, both parties agree to resolve the matter through arbitration. The Agency is not responsible for consequential damages or lost opportunities resulting from property transaction issues beyond its control.
